1. Nature of Service & Emergency Disclaimer
Aapth is a technology facilitation platform, not a service provider. We do not operate cab services, grocery delivery, medical, or any other fulfilment service. All bookings and orders are facilitated through independent Third-Party Service providers.
EMERGENCY DISCLAIMER: Aapth is NOT an emergency response service. Do not use Aapth to request ambulances, police, fire response, or urgent medical help. The platform is not monitored by human operators for life-threatening situations.
2. AI Translations & Limitations
The Platform uses artificial intelligence to interpret User requests. AI responses and language translations are probabilistic and may contain errors. AI speech-to-text transcription may produce errors, particularly with regional accents, code-mixed language, and proper nouns including place names.
Users and Family Administrators are solely responsible for reviewing and confirming critical information (such as destination addresses or grocery items) at the confirmation steps before a booking is finalized.
3. Anti-Fraud & Financial Security
Aapth will NEVER ask you for your bank details, UPI PIN, credit card numbers, or One-Time Passwords (OTPs) via WhatsApp message. Do not share financial credentials with any contact claiming to be Aapth. The Company is not liable for financial loss resulting from spoofing, phishing, or social engineering attacks targeting Users outside the verified platform architecture.
4. Privacy Policy & DPDP Act Compliance
We collect your WhatsApp phone number, session metadata, explicit location shares, and optionally Jataka data (only with explicit consent). Voice notes are processed for transcription but the audio files are not retained after processing.
Cross-Border Transfer Consent: By using Aapth, you explicitly consent to the transfer of your text inputs to our secure AI service providers (including Anthropic PBC) which may process data outside the Republic of India, in strict accordance with the Digital Personal Data Protection Act, 2023.
5. Platform Dependency & Force Majeure
Aapth operates entirely via the WhatsApp Business API. The Company is not liable for service interruptions, data loss, or inability to access the Platform caused by WhatsApp/Meta platform outages, account bans, policy changes by Meta, or other telecommunication failures beyond our control.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's aggregate liability to any User for all claims arising from or relating to use of the Platform shall not exceed the greater of: (A) the total fees paid by the User to the Company in the twelve (12) months preceding the claim; or (B) INR 500 (Five Hundred Rupees).
7. Governing Law
These Terms and all disputes arising from or relating to the Platform shall be governed by and construed in accordance with the laws of the Republic of India. Disputes shall be referred to arbitration in Bengaluru, Karnataka.
